    The Maharashtra Real Estate Regulatory Authority (MahaRERA) has released order mandating builders to disclose the details about the amenities to homebuyers that will be provided to them in the project in sale agreements.

    Important Points

    Detailed Listing of Facilities/Amenities: Builders are required to specify all facilities and amenities provided in the building, common areas, or layout, including but not limited to swimming pools, badminton courts, tennis courts, table tennis courts, squash courts, among others.

    Size/Area and Availability Dates: The Sale agreement should stipulate the information regarding the size or area of the amenities and the dates when they will be made available for use by the Homebuyers, their family members, and residents.

    Manner of Disclosure: The order specifies the manner in which facilities and amenities should be detailed in the proforma of the agreement for sale, as outlined in Annexure 1 attached to the order.

    Non-Negotiable Clause: Furthermore, the order emphasizes that the clause regarding amenities disclosure, as outlined in Annexure 1, is non-negotiable. Failure to include this clause in the sale agreements or any modifications thereof will attract action from the MahaRERA.

    Therefore, the order mandates comprehensive disclosure of amenities which aims to safeguard and protect the rights of homebuyers.
